Plans for the construction of the proposed 300 MW Wind Farm in Bubisa, Marsabit County, Kenya, by Gitson Energy, a Kenyan diaspora-owned company have been revived after the High Court gave a favorable ruling following five years of legal proceedings.

Gitson Energy had applied and received approval from the Ministry of Energy and Petroleum in 2010 to start the wind power project. Land gazette issues however delayed the project, forcing the company to seek the court’s intervention. After the land matter was resolved, the project faced further delays, with the Energy Ministry presenting what the company claimed were new hurdles to stall the project.

The turning point

The High Court sitting in Mombasa, led by Judge Pauline Nyamweya recently gave an order to the Energy and Petroleum Regulatory Authority (EPRA) and the Ministry of Energy to include the 300 MW Wind Farm in Bubisa in the Commission’s list approved power projects.

“An order of mandamus, (which in layman’s language is an order from a court to an inferior government official) be and is hereby issued to compel the second (Ministry of Energy) and (EPRA) fourth respondents to forthwith include the ex parte applicant’s 300MW wind energy project in the fourth respondent’s list of approved projects, and to, in consultation with the ex parte applicant, issue the appropriate permit and license to the ex parte applicant,” said Justice Nyamweya in her ruling.

Subsidy for the construction of the 300 MW Wind Farm in Bubisa

The independent power producer (IPP) received promises of financing from the U.S. Export Credit Agency (U.S. Exim Bank) and the Overseas Private Investment Corporation (OPIC), which has since become the U.S. Development Finance Corporation (DFC) following a merger with the Development Credit Authority (DCA) of the U.S. Agency for International Development (USAID).
